# Journey Terms & Conditions

These Terms & Conditions govern the consumer websites, mobile applications, Journey account, and related services provided by Journey Rewards Inc., doing business as Journey, Journey Experiences and Epicurate ("Journey," "we," "us"), including [journey.com](https://www.journey.com) and [epicurate.vip](https://epicurate.vip). They also govern Journey-operated features on a partner's website when identified as such. A partner's separate business and website remain subject to its own terms. "You" means the individual using the services. These Terms take effect when you accept them or, for an existing member, on the effective date in the notice provided to you, subject to Section 15.

IMPORTANT: Section 14 contains an individual arbitration agreement and class-action waiver for eligible United States disputes, with exceptions and a 30-day opt-out. Mandatory consumer rights are preserved throughout these Terms.

## 1. Our agreement and applicable terms

By selecting an acceptance control that links these Terms, creating an account through that control, or completing another expressly identified acceptance process, you agree to these Terms. Mere delivery of an email or publication of revised terms does not itself authorize a charge, optional marketing, a new connected account, or expanded data sharing.

The Journey Membership & Loyalty Terms at [journey.com/loyalty-terms](https://www.journey.com/loyalty-terms) govern membership, status, points and awards. The Earning Terms at [journey.com/earning-terms](https://www.journey.com/earning-terms) govern qualifying activity. The Legend Paid Membership Terms at [journey.com/legend-terms](https://www.journey.com/legend-terms) apply only to an accepted paid subscription. The Journey Concierge & Threads AI Supplemental Terms at [journey.com/concierge-terms](https://www.journey.com/concierge-terms) apply when you separately enable those features. The Booking Terms at [journey.com/booking-terms](https://www.journey.com/booking-terms) govern reservations, and the Experience Booking Terms at [journey.com/experience-terms](https://www.journey.com/experience-terms) and [epicurate.vip/experiences/terms](https://epicurate.vip/experiences/terms) additionally govern experiences. The EULA at [journey.com/eula](https://www.journey.com/eula) governs the mobile application license. The Messaging Terms at [journey.com/sms-terms](https://www.journey.com/sms-terms) apply to messaging programs. Each is incorporated when applicable. Our Privacy Policy at [journey.com/privacy](https://www.journey.com/privacy) and Cookie Policy at [journey.com/cookies](https://www.journey.com/cookies) explain information practices; acknowledging them is not blanket consent to optional processing.

Mandatory law controls. Next, the accepted transaction-specific terms control the particular purchase, the applicable supplemental terms control their specific subject, and these Terms govern generally. An offer can expressly enhance a benefit but cannot silently remove protections in these Terms. A partner's terms do not expand its access to your Journey account or waive Journey's own obligations. Business customers' software subscriptions and Alliance Partner agreements are governed by separate agreements.

## 2. Eligibility, applications and accounts

You must be a natural person at least 18 years old and of legal majority where you reside, have capacity to contract, provide accurate identity and contact information, and be in a location where we offer the relevant service lawfully. Age-restricted activities may require a higher age and separate verification. Membership is personal; entities cannot enroll as individual members. No purchase or invitation overrides these requirements.

We may require an invitation, identity or payment verification, residency information, or additional fraud-prevention checks, and may decline or limit applications for lawful eligibility, capacity, safety, sanctions, regulatory or operational reasons. You must not use the services if applicable sanctions or export laws prohibit us from providing them to you, or use another identity, device, intermediary or location-masking method to evade a restriction. Previously suspended or removed users require our written approval to rejoin. We apply these rules consistently with applicable nondiscrimination law.

Maintain one personal account unless we approve otherwise. Keep credentials secure and information current; promptly report suspected compromise. Do not share credentials or transfer an account. Authorized sharing must use the permission features we provide. You are responsible for activity you authorize and for losses caused by your breach of these obligations, not automatically for every unauthorized act or Journey security failure. We may merge duplicate accounts following verification without duplicating benefits.

## 3. Permitted use and intellectual property

We grant a limited, personal, nonexclusive, nontransferable license to use the services as provided, subject to these Terms. Journey and its licensors retain the software, designs, trademarks, systems and other proprietary rights. No ownership interest or commercial redistribution right is granted.

Do not commit fraud, abuse incentives, resell restricted rates or awards, make speculative bookings, impersonate others, harass people, upload unlawful or infringing material, distribute malware, bypass eligibility or security controls, access another person's information without permission, or interfere with service operations. Do not scrape or systematically extract content, reverse engineer except where law permits, or use protected service content to train competing models without permission. Documented Journey APIs, approved integrations and expressly enabled AI connections are allowed within their published permissions; they do not authorize broader automation, data extraction, or payment activity. Lawful security reporting and nonwaivable interoperability rights are not prohibited.

## 4. Listings, bookings, purchases and payment roles

A listing, search result, AI response, points estimate or displayed availability is not a reservation, price hold or guarantee. Review the final price, currency, taxes, mandatory charges, inclusions, eligibility, cancellation rules, payment schedule and identified supplier before confirming. A transaction is confirmed only through the designated confirmation process. We may correct errors before confirmation; after confirmation, changes or cancellation for an error are subject to the accepted terms and law, including any required refund or renewed approval.

The hotel, host, experience provider, merchant or other identified supplier is responsible for its own goods, services, personnel, premises, safety, licensing and fulfillment. Journey may operate the booking interface, administer loyalty, act as a disclosed booking intermediary, or perform an identified payment role. For Journey Experiences or Epicurate bookings, the checkout must identify whether Journey Rewards Inc. under the applicable brand is merchant of record, or the provider or identified distribution partner is merchant of record using Stripe Connect or another disclosed payment arrangement. Stripe supplies payment infrastructure; it is not thereby the seller or experience provider. Payment facilitation alone does not make Journey the underlying service provider, and merchant-of-record status does not eliminate the duties imposed on the entity holding that role.

Authorize only payment methods you may lawfully use. Your approval covers the disclosed transaction and any separately accepted deposit, installment, cancellation or incidental charges, not unrelated purchases. Subscription payment permission is governed by the applicable subscription terms. We may receive commissions, referral fees or other compensation; recommendations and rankings may reflect commercial relationships, which we disclose where required. No universal lowest-price or savings guarantee is made.

Refunds follow the accepted booking terms and mandatory law. Supplier deposits and advance payments may be required and disclosed before purchase. A supplier payout or the label "non-refundable" does not extinguish a consumer's statutory refund, chargeback or nonperformance rights. We may help resolve supplier problems without becoming guarantor of the supplier's obligations. Nothing disclaims Journey's own express commitments or nonwaivable duties.

## 5. Your content, reviews and suggestions

You retain rights you hold in your submissions. You authorize Journey and its service providers to host, process, transmit, format and display private content only as needed to provide, secure and improve the services consistently with the Privacy Policy and your permissions. This does not license public advertising use of your private conversations or unrestricted AI training.

For content you intentionally publish, such as a public review or photograph, you grant a worldwide, nonexclusive, royalty-free license to display, reproduce, distribute, translate and reasonably adapt it in connection with the services and promotion of that public content. Do not submit confidential information for public posting. We may moderate or remove unlawful, misleading or policy-violating content; this does not promise universal pre-screening. Removal ends future uses within our control, except reasonable backups, legal records and uses already distributed lawfully. You must have the necessary rights and permissions. We may use voluntary product suggestions without compensation, but not contrary to confidentiality or privacy obligations.

## 6. Membership, partner programs and sharing directions

Journey membership is required for participation in identified loyalty programs in the Journey Alliance network. The name of a membership, tier, program or platform may change without changing the substance of an accepted obligation. A rename alone does not create a paid subscription.

When a transaction flow clearly identifies an Alliance Partner program and asks you to accept its terms, completing that flow enrolls you in the identified program and directs the necessary exchange of information described in the Membership & Loyalty Terms and Privacy Policy. Sign-in on a partner domain must identify the receiving partner and sharing purpose. You do not thereby join every network program, consent to unrestricted partner marketing, or give every partner your full profile, other partners' history, or private Concierge conversations.

## 7. AI features and connected services

AI may generate inaccurate or incomplete recommendations, summaries and other outputs. Verify important details with authoritative sources. AI output is not professional advice, a confirmed transaction, or a promise of a benefit. Do not use the services for emergencies or as a substitute for medical, legal, financial or safety advice. Optional Concierge, agent actions, connected accounts and Trusted Contacts require the additional permissions described in the Concierge supplemental terms. A general goal is not unrestricted authority to spend, disclose sensitive information or bind you to new commitments.

## 8. Privacy and communications

Our Privacy Policy covers Journey accounts, partner-domain sign-in, authorized profile sharing, connected services, personalization and your choices. You must have authority to provide another person's information. Do not provide highly sensitive information unless requested through an appropriate secure feature for a permitted purpose.

We send account, security, transaction and legal communications through appropriate channels. Marketing enrollment is separate; opt-out and channel controls remain available. Text-message consent can be revoked under the Messaging Terms and applicable law, including for service texts. An email unsubscribe does not prevent a necessary nonmarketing legal notice, but we will not disguise promotions as service messages.

## 9. Service changes and availability

We may maintain, replace, improve, restrict or discontinue features for business, security, legal or operational reasons. Availability may vary by location, device, tier and provider. Beta features may be incomplete. We do not promise that every feature, integration or partner will continue indefinitely. Material changes to contracted paid access, loyalty benefits or these Terms follow the relevant notice and remedy provisions; a general change right does not override them.

## 10. Suspension, termination and outstanding obligations

We may restrict access promptly to address suspected fraud, misuse, payment failure, safety threats, unauthorized access or legal requirements. Where practicable and lawful, we provide the reason and an opportunity to resolve a remediable issue. You may contact legal@journey.com to request review. We may end an ordinary account relationship with reasonable notice, subject to paid-term and earned-benefit protections.

You may stop using the services, cancel renewal, or request account closure. Those are different actions: cancellation of Legend renewal ordinarily preserves access through the paid term; uninstalling an app does not cancel a subscription; deleting an account does not cancel third-party reservations. We will identify outstanding Journey-billed subscriptions in the closure process and stop future Journey-billed renewals when closure is completed. Store-billed subscriptions require the applicable store cancellation process, with assistance available from us. Mandatory deletion and refund rights remain unaffected.

Termination does not erase lawful accrued charges or confirmed supplier obligations. Points, awards and paid access are handled under their governing terms. We may retain records as explained in the Privacy Policy. Provisions that inherently need to continue, including accrued payment obligations, intellectual property, permitted retention, liability and dispute resolution, survive.

## 11. Warranties and responsibility

TO THE EXTENT PERMITTED BY LAW, THE SERVICES AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. These disclaimers do not negate an express commitment in an accepted offer or exclude statutory guarantees, reasonable-care duties or remedies that cannot lawfully be excluded.

We are not responsible merely because an independent partner fails to perform its own obligations. This allocation is subject to Journey's actual role in the transaction, its own conduct and mandatory law. Events beyond our reasonable control may delay performance, but do not authorize us to retain money that law requires us to refund or to disregard reasonable mitigation duties.

## 12. Limits of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNEY AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND SERVICE PROVIDERS ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM THE SERVICES. Their combined aggregate liability for related claims will not exceed the greater of US$100 or the membership and service fees you paid to and retained by Journey for your use of the services during the 12 months before the event giving rise to the claim. Supplier charges passed through by Journey and the notional redemption value of points are not service fees for this calculation.

This cap does not reduce amounts Journey must return as a refund, funds it must remit or account for, or an expressly promised account correction or points redeposit. Neither the cap nor any exclusion applies to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or remedy that cannot be limited by applicable law. Nonwaivable consumer, privacy, payment and statutory rights remain intact. These limitations apply only to the extent lawful in your jurisdiction, including jurisdictions that restrict exclusions for direct or consequential losses.

## 13. Third-party claims caused by your misconduct

To the extent permitted by law, you will reimburse Journey for reasonable losses, costs and legal fees awarded or reasonably incurred in a third-party claim caused by your unlawful conduct, knowing infringement, fraud, or material breach of these Terms. This does not cover Journey's own breach, negligence or other fault, or impose indemnity merely for ordinary use or a good-faith consumer complaint. We will give prompt notice, permit reasonable participation in the defense and not settle in a way that admits your fault or imposes a nonmonetary obligation on you without your consent, not unreasonably withheld.

## 14. Disputes, individual arbitration and opt-out

14.1 Informal resolution. Please send legal@journey.com a description of a dispute, your account contact details and the relief requested. Journey will send its notice to your account contact address. We will try in good faith to resolve a dispute for 60 days after receipt. Applicable limitation periods are paused during that process to the extent permitted by law. This process does not restrict regulator complaints, timely small-claims filings, urgent interim relief or nonwaivable rights.

14.2 United States arbitration. If you reside in the United States and do not opt out, you and Journey agree to resolve disputes arising from these Terms or the services through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and Consumer Due Process Protocol, available at adr.org. The Federal Arbitration Act governs this agreement. Either party may instead bring an eligible individual case in small-claims court. Claims for public injunctive relief where that relief cannot lawfully be waived or arbitrated, and applications for urgent relief concerning intellectual property or unauthorized system access, may be brought in court.

14.3 Fair process. Hearings may be remote or in your county of residence unless another location is agreed. Filing, administrative and arbitrator fees follow the applicable consumer rules; Journey will pay amounts required of it and any additional amount necessary to avoid making arbitration prohibitively expensive compared with court. Statutory remedies and fee awards remain available. A court decides contract formation and the validity or scope of the arbitration and class-waiver provisions; the arbitrator decides the merits of arbitrable claims. If AAA cannot administer the matter and the parties cannot agree on an appropriate alternative, either may proceed in a competent court. No contractual batching protocol delays an individual claim. Sexual-assault or sexual-harassment claims may be brought in court, and no pre-dispute provision restricts a statutory election of a court forum.

14.4 Individual proceedings. Where lawful, you and Journey waive jury trial and class or representative proceedings for claims subject to this arbitration agreement. The arbitrator may award individual relief but may not conduct class arbitration without both parties' written agreement. A nonwaivable claim or remedy is severed and may proceed in court without extinguishing the remaining arbitration agreement. Nothing prevents lawful coordinated representation, regulatory action, or a mutually agreed settlement.

14.5 Opt-out. You may reject arbitration and its associated class waiver by emailing legal@journey.com within 30 days after first accepting this arbitration agreement, giving your name, account email and a clear opt-out statement. There is no penalty for opting out. We honor valid prior opt-outs. A material change to this arbitration provision requires notice and a new opportunity to reject the change; it does not govern a previously notified dispute without both parties' agreement.

14.6 Governing law and courts. New York law governs, subject to the Federal Arbitration Act and mandatory protections of your residence. For disputes not arbitrated, New York County state or federal courts have jurisdiction, except that mandatory local consumer jurisdiction and eligible small-claims venues remain available. For consumers outside the United States, mandatory pre-dispute arbitration and class waivers in this section do not apply. Nothing prevents an eligible consumer from bringing proceedings in their home courts under applicable law. Claims are subject to applicable statutory limitation periods, not a shortened contractual deadline.

## 15. Changes and existing rights

We provide at least 30 days' advance notice of material changes to these Terms, and at least 45 days for a material reduction in ongoing loyalty earning, redemption value or program benefits, new mandatory program fees, or program termination. Longer legal or previously promised periods apply. Legal, security or fraud-prevention changes may take effect sooner where reasonably necessary, with notice as soon as practicable. A change is prospective and does not silently rewrite a confirmed purchase, vested award condition or accrued claim.

Continued use after adequate notice may indicate acceptance where law allows; we obtain renewed affirmative agreement where required. A notice is not consent to a new recurring charge or optional processing. If you do not accept a change, you may stop using the affected service and cancel renewal. Paid-term protections, transition protections and any mandatory cancellation or refund rights still apply.

## 16. General and contact

These Terms and applicable accepted supplements form the agreement for their subject matter. An invalid provision is severed or limited only as law permits; the remainder continues. A failure to enforce is not a waiver. You may not assign your account or agreement without permission. Journey may transfer its agreement in a reorganization, merger or sale without reducing your protections and will give notice where required. Except for the protected persons expressly identified in Section 12 and Apple as stated in the EULA, there are no third-party beneficiaries. Neither a partnership nor a general fiduciary relationship is created.

We provide records and notices electronically in a form you can retain; contact us for accessibility assistance or another format required by law. English is the reference language except where local law requires a different controlling language. Consumer rights in the EEA, UK, Australia and other protected jurisdictions are not waived.
